In this privacy policy, we, Kovacs-Experience (hereinafter Kovacs-Experience, we or us), explain how we collect and otherwise process personal data.

 

The use of our website is generally possible without providing personal data. Insofar as personal data (for example, name, address or e-mail addresses) are collected on our site, this is always done, as far as possible, on a voluntary basis.

2. COLLECTION AND PROCESSING OF PERSONAL DATA

 We primarily process personal data that we receive from business partners and other persons involved in our business relationship with them or that we collect from their users when operating our website.

 

To the extent permitted, we also take certain data from publicly accessible sources (e.g. debt collection registers, land registers, commercial registers, press, Internet) or receive such data from authorities and other third parties (such as credit agencies, address dealers).

 

We process personal data for the period of time necessary for the purpose(s) in question or as required by law.

 

3. PURPOSES OF DATA PROCESSING AND LEGAL BASIS

When using this website, personal data is only collected in connection with the provision of a service requested by you (e.g. inquiry, etc.). This data is used to provide the service and may be disclosed by us to third parties where permitted and appropriate. If you contact us by e-mail or contact form, the information you provide will be stored for the purpose of processing the request and for possible follow-up questions.

 

Insofar as you have given us consent to process your personal data for specific purposes, we process your personal data within the scope of and based on this consent, insofar as we have no other legal basis and we require such a basis. Consent given can be revoked at any time, but this has no effect on data processing that has already taken place. The revocation can be addressed in writing or by e-mail to info@kovacs-experience.ch.

 

 

4. SPECIAL PROVISIONS FOR THE USE OF OUR WEBSITE

 

4.1 Log data

 

The provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

 

Browser type and browser version, operating system used, referrer URL, host name of the accessing computer, time of the server request.

 

This data cannot be assigned to specific persons. A combination of this data with other data sources is not made. We reserve the right to check this data retrospectively if we become aware of concrete indications of illegal use.

 

4.2 Personal data that you make available to us

 

It is not necessary to provide personal data (registration) to use our website.

 

However, you can contact us on a voluntary basis via a contact form. In doing so, personal data is collected and transmitted to us. Which data this is, can be seen from the input mask. The data transmitted by you will be stored by us for the purpose of processing or contacting you.

 

4.3 Cookies

 

We use cookies on our website. These are small text files that are sent to your computer or automatically stored on your computer or mobile device by the web browser you use when you visit our website. This allows us to recognize you when you return to our website, even if we do not know who you are.

 

Cookies collect usage information; in particular, the date and time you access our website or app and your Internet Protocol (IP) address. They help us to make your visit to our website attractive and to enable you to use certain functions. They provide information about which website or app our pages are accessed from. We can also use cookies to track topics that our visitors research and how long they spend on individual pages.

4.4 Google reCAPTCHA

 

To protect our contact form, we use reCAPTCHA, a captcha service operated by Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

 

The use of reCAPTCHA makes it possible to distinguish whether a certain action on the Internet (in particular the entries in our contact form) is performed by a human being or by a computer program or bot.

4.5 Profiles in Social Networks


We maintain online presences within social networks in order to communicate with the users active there or to offer ind information about us there.

We would like to point out that user data may be processed outside the European Union. This may entail risks for users, e.g. by making it more difficult to enforce users' rights. With regard to US providers certified under the Privacy Shield or offering comparable guarantees of a secure level of data protection, we would like to point out that they thereby commit themselves to comply with EU data protection standards.

In addition, user data is usually processed within social networks for market research and advertising purposes. For example, user profiles can be created on the basis of user behaviour and the associated interests of users. The user profiles can then be used, for example, to place advertisements within and outside the networks which are presumed to correspond to the interests of the users. For these purposes, cookies are usually stored on the user's computer, in which the user's usage behaviour and interests are stored. Furthermore, data can be stored in the user profiles independently of the devices used by the users (especially if the users are members of the respective networs or will become members later on).

Also in the case of requests for information and the exercise of rights of data subjects, we point out that these can be most effectively pursued with the providers. Only the providers have access to the data of the users and can directly take appropriate measures and provide information. If you still need help, please do not hesitate to contact us.

4.7 Onlinemarketing


We process personal data for the purposes of online marketing, which may include in particular the marketing of advertising space or the display of advertising and other content (collectively referred to as "Content") based on the potential interests of users and the measurement of their effectiveness.

For these purposes, so-called user profiles are created and stored in a file (so-called "cookie") or similar procedure in which the relevant user information for the display of the aforementioned content is stored. This information may include, for example, content viewed, websites visited, online networks used, communication partners and technical information such as the browser used, computer system used and information on usage times. If users have consented to the collection of their sideline data, these can also be processed.

The IP addresses of the users are also stored. However, we use provided IP masking procedures (i.e. pseudonymisation by shortening the IP address) to ensure the protection of the user's by using a pseudonym. In general, within the framework of the online marketing process, no clear user data (such as e-mail addresses or names) is secured, but pseudonyms. This means that we, as well as the providers of online marketing procedures, do not know the actual identity of the users, but only the information stored in their profiles.

The information in the profiles is usually stored in the cookies or similar memorizing procedures. These cookies can later, generally also on other websites that use the same online marketing technology, be read and analyzed for purposes of content display, as well as supplemented with other data and stored on the server of the online marketing technology provider.

Exceptionally, clear data can be assigned to the profiles. This is the case, for example, if the users are members of a social network whose online marketing technology we use and the network links the profiles of the users in the aforementioned data. Please note that users may enter into additional agreements with the social network providers or other service providers, e.g. by consenting as part of a registration process.

As a matter of principle, we only gain access to summarised information about the performance of our advertisements. However, within the framework of so-called conversion measurement, we can check which of our online marketing processes have led to a so-called conversion, i.e. to the conclusion of a contract with us. The conversion measurement is used alone for the performance analysis of our marketing activities.

Unless otherwise stated, we kindly ask you to consider that cookies used will be stored for a period of two years.

Information on legal basis: If we ask users for their consent (e.g. in the context of a so-called "cookie banner consent"), the legal basis for processing data for online marketing purposes is this consent. Otherwise, user data will be processed on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online services. In this context, we would also like to refer you to the information on the use of cookies in this privacy policy.

5. DATA TRANSFER AND

DATA TRANSFER ABROAD

We also disclose personal data to third parties as part of our business activities and for the purposes mentioned in section 3, as far as this is permitted and indicated. This particularly concerns service providers, including order processors (such as IT providers) and other business partners.

We use services from third parties in order to be able to use the digital infrastructure required for our offer. These include, in particular, hosting and storage services from specialized providers. Such providers process - usually exclusively on our behalf - the data that are necessary for the operation of this infrastructure. This includes in particular your Internet Protocol (IP) address (anonymized). We also guarantee adequate data protection with such providers.

Some of the recipients are in Germany, but they can also be abroad. If we transfer data to a country in which there is no adequate statutory level of data protection, we will ensure an adequate level of protection by concluding appropriate contracts or rely on the existing statutory exceptions.


6. DATA SUBJECT RIGHTS
You have the right to information, correction, deletion, restriction of data processing and otherwise the right to object to our data processing within the framework of the data protection law applicable to you and to the extent provided therein. Please note, however, that we reserve the right to enforce the legally stipulated restrictions on our part, for example if we are obliged to store or process certain data, have an overriding interest in it (insofar as we can refer to it) or if we are required to assert Need claims.
